1. Acceptance of Terms

By accessing or using the websites, tools, applications, or diagnostic services operated by Legacy Risk ("Legacy Risk", "we", "us", or "our"), including legacyrisk.co.za, a1audit.legacyrisk.co.za, easytrac.legacyrisk.co.za, and associated portals, you confirm that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our PAIA Manual.

If you are accessing our services on behalf of a company, close corporation, trust, or other legal entity, you represent and warrant that you possess the requisite legal authority to bind that entity to these terms.

Our automated scanning solutions, specifically the A1 Website Security & Compliance Audit, are engineered to inspect publicly exposed web parameters (such as public SSL/TLS certificates, HTTP security response headers, page response latency, and public privacy policies).

You warrant that any website URL or domain name submitted by you for scanning is either owned by your organization or that you have received express permission from the domain owner to request a public diagnostic assessment.

4. No Formal Legal or Statutory Labor Representation

Content published on our platforms, including guides regarding the Protection of Personal Information Act (POPIA), the Private Security Industry Regulatory Authority (PSIRA), and National Bargaining Council for the Private Security Sector (NBCPSS) wage rates, is intended for operational guidance and compliance awareness.

Nothing on our website or software constitutes formal legal advice, labor law representation, or certified financial auditing. Clients requiring binding legal representation or CCMA representation must engage qualified legal practitioners.

5. Intellectual Property Rights

All proprietary algorithms, software source code, user interface designs, logos, trademarks, database schemata, and editorial content published on Legacy Risk platforms are the exclusive property of Legacy Risk or its licensors, protected under South African copyright legislation, international treaties, and common law.

Users may not decompile, reverse-engineer, copy, scrape, mirror, or extract proprietary code or data without our express written consent.

6. Acceptable Use Policy

You agree not to use Legacy Risk platforms or services to:

• Submit fraudulent, defamatory, or unlawful domains or contact details.
• Attempt unauthorized access to any server, database, or infrastructure connected to Legacy Risk.
• Execute distributed denial of service (DDoS) attacks, brute-force requests, or automated abuse against our diagnostic endpoints.
• Interfere with or disrupt the normal operation of any service provided to other clients.

7. Limitation of Liability

To the maximum extent permitted by the laws of the Republic of South Africa (including the Consumer Protection Act 68 of 2008 where applicable):

• Legacy Risk provides automated diagnostic scans, informational materials, and trial software on an "as is" and "as available" basis without express or implied warranties of any kind.
• Legacy Risk, its directors, employees, affiliates, and technical partners shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of business profits, loss of data, operational downtime, or regulatory penalties incurred by your organization.
• Our total cumulative liability arising out of or related to these terms or our services shall not exceed the total fees actually paid by you to Legacy Risk in the twelve (12) months preceding the claim, or R1,000 (One Thousand South African Rand), whichever is greater.

8. Governing Law & Dispute Resolution

These Terms of Service are governed exclusively by and construed in accordance with the laws of the Republic of South Africa.

Any dispute arising out of or in connection with these terms, our software, or our services that cannot be amicably resolved between the parties within twenty-one (21) days of written notice shall be submitted to the non-exclusive jurisdiction of the High Court of South Africa (Gauteng Division, Johannesburg).
